These Terms of Service (“Terms”) are a binding agreement between you and Garden Heights (“Garden Heights,” “we,” “us,” or “our”) governing your access to and use of our website at gardenheightsacademy.com, our online workbooks, and our downloadable Teacher and Student editions (together, the “Service”). By creating an account, subscribing, purchasing, or otherwise using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.
The Service is intended for teachers, parents, guardians, and their students. Our readers are often children, so accounts for students under the age of 18 must be created and supervised by a responsible adult (a parent, guardian, or teacher), who is responsible for that student’s use of the Service. By subscribing, you confirm you are an adult with authority to enter into these Terms.
You are responsible for keeping your account credentials confidential and for all activity under your account. Your subscription is a single account for one household or classroom, with a limited number of devices. You agree to provide accurate information and to keep it up to date. Sharing an account beyond the limits of your plan is not permitted.
You may cancel your subscription at any time from your account or by emailing [email protected]. Cancellation stops future renewals; you retain access until the end of the current paid period. Canceling does not by itself entitle you to a refund — refunds are governed by Section 6.
Our refund terms are set out in full in our Refund Policy. In summary: the online subscription has a one-time 7-day no-questions refund from each charge date; workbook PDFs are refundable only while untouched, and become final the moment any PDF in the order is opened online. Nothing in these Terms limits any non-waivable refund or withdrawal rights you may have under applicable consumer law (see Section 16).
Taking the no-questions refund closes your account and permanently deletes your records; we retain a one-way fingerprint of your email to enforce this limit and prevent abuse, as described in the Refund Policy and Privacy Policy. The no-questions refund is a one-time courtesy; a second refund from the same email is the last, and after a second refund that email can no longer be used to create or access a Garden Heights account. We may decline further or abusive refund requests — including attempts to evade this limit by creating additional accounts — and may restrict access in those cases, without limiting your non-waivable statutory rights.
Subject to these Terms and your active plan, Garden Heights grants you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for your own classroom or family for non-commercial educational purposes.
Print from the webpage only. Workbook PDFs are provided for printing directly from the Garden Heights webpage. Downloading, saving, exporting, or otherwise storing the PDF file is not permitted, and any record of the file being downloaded or saved may be used as evidence in a legal dispute.
You may not exceed the limits of your plan; download, save, store, or retain the PDF file; reproduce, distribute, share, sell, sublicense, or publicly post any Knowledge Bank, question, reading passage, activity, or other content, in whole or in part, for any commercial purpose or beyond your own classroom or family; or compile, bind, or republish the materials as a collection for sale or external distribution. All rights not expressly granted are reserved.
You agree not to misuse the Service, including by: attempting to access accounts, data, or systems you are not authorized to use; copying, scraping, or harvesting content except as permitted by your license; circumventing access controls, paywalls, or usage limits; interfering with or disrupting the Service; or using the Service to violate any law or the rights of others.
The Service and all of its content — including text, questions, reading passages, Knowledge Banks, activities, designs, logos, and software — are owned by Garden Heights or its licensors and are protected by copyright and other laws. “Garden Heights” and our logo are our marks. Our study guides are independent works of original analysis; they are not affiliated with, authorized by, or endorsed by any author or rights holder, and they do not reproduce text from the novels they accompany.
The Service relies on third parties (for example, payment processing and website hosting). Your use of those services may be subject to their own terms, and we are not responsible for third-party services.
The Service is provided on an “as is” and “as available” basis. To the maximum extent permitted by law, we disclaim all warranties, whether express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that content is complete or suitable for any particular educational outcome.
To the maximum extent permitted by law, Garden Heights will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, revenue, or profits, arising out of or relating to your use of the Service. To the extent we are found liable, our total liability for any claim relating to the Service will not exceed the amount you paid us in the 12 months before the event giving rise to the claim. Nothing in these Terms excludes liability that cannot be excluded under applicable law.
You agree to indemnify and hold harmless Garden Heights from any claims, damages, and reasonable expenses arising out of your breach of these Terms or your misuse of the Service.
We may suspend or terminate your access if you breach these Terms or use the Service in a way that may cause harm or legal exposure. You may stop using the Service at any time. Sections that by their nature should survive termination (including license restrictions, intellectual property, disclaimers, limitation of liability, and governing law) will survive.
We may modify the Service or these Terms from time to time. When we change these Terms, we will update the “Last updated” date above and, where appropriate, provide additional notice. Your continued use of the Service after changes take effect means you accept the revised Terms.
These Terms are governed by the laws of the Republic of Korea, without regard to conflict-of-laws rules. Subject to any mandatory consumer-protection rights that apply where you live, you and Garden Heights agree to submit to the exclusive jurisdiction of the courts located in Seoul, Republic of Korea. If you are a consumer, nothing in these Terms removes the protections granted to you by mandatory provisions of applicable consumer law, including, where applicable, the Act on the Consumer Protection in Electronic Commerce and related regulations.
